Terms & Conditions

The following terms and conditions apply to all design services offered by Crocusfield (Cigdem Guven of Crocusfield). By requesting services from Crocusfield you (the client) are considered to have accepted these terms and conditions in full whether or not you have been provided with a copy. If you have any questions regarding these terms and conditions, please get in touch.
Design and revisions 
Depending on what the graphic design project is, you will be presented two to five initial design ideas, developed to one main design, plus the opportunity for you to make up to three rounds of revisions, for each graphic item listed in the proposal. 
If the scope of the project changes during the project’s completion,  additional costs will be confirmed in writing prior to doing the work and I would not proceed with the extra work unless you give an approval for it. 
Text content  
Crocusfield is not responsible for writing or editing any text copy unless specified in the original estimate. If you’d like new content to be written for you or content to be edited, Crocusfield can outsource that service.
External costs  
You should supply your graphic files in an editable, vector digital format. (preferably Adobe Illustrator format) You should supply photographs in a high resolution digital format. If you choose to buy stock photographs, Crocusfield can suggest stock libraries. 
External or outsourced supplier costs, including stock images or printing support will be separate to Crocusfield’s costs. 
Copyrights & ownership 
First, you guarantee that all elements of text, graphics, photos, designs, trademarks, or other artwork you provide are either owned by your good selves, or that you’ve permission to use them. Crocusfield guarantees that all elements of the work delivered to you are either owned by Crocusfield or permission is obtained to provide them to you. You own all elements of text, images and data you provided, unless someone else owns them. 
When your final payment has cleared, copyright will be automatically assigned as follows: 
All final visuals Crocusfield created for this project in the format agreed on at the beginning  will become your property upon full payment of our invoices.

Source files (Illustrator / Indesign / Photoshop files) remain the property of Crocusfield. In case you would like to purchase the source files, please ask for a quote.
Crocusfield loves to show off and share her work with other people, so Crocusfield reserves the right, with your permission, to display and link to your project as part of her online portfolio & for marketing/advertising of her services, both on and offline.
Payments  
Crocusfield is sure you understand how important it is as a small business that you pay the invoices that has been sent to you promptly. Crocusfield would kindly ask you to stick to the following payment schedule: 
 50% of the fee is due by bank transfer upon approval of the proposal and Terms & Conditions and the deposit is non- refundable.
 Remainder of fee payable not more than 14 days after receipt of finished product and invoice.
 Additional work outside the originally outlined quote will be billed at an hourly rate of €70+VAT.
✻ All payments are non-refundable even if the design assets are not used by client.
Client approval  
You will be required to proofread and approve all elements of final designs. Approval must be provided before production can continue and artwork is released. Upon acceptance of the work, you accept responsibility for any further processes in which this work is used. (e.g. film outpost, printing, etc.) Crocusfield is not responsible for errors occurring in this work or projects related to this work after acceptance of the work by you.

Cancellation  
If you choose to cancel this project after the project’s completion, you will remain responsible for full payment of the complete project total. Upon cancellation of this agreement before the project’s completion, you will be responsible for all expenses incurred prior to the termination of the agreement.
Legal stuff                 
Crocusfield carries out her work in accordance with good industry practice and at the standard expected from a suitably qualified person with relevant experience. That said, Crocusfield can’t guarantee that her work will be error-free and so can’t be liable to you or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you’ve advised Crocusfield of them. 
Your liability to Crocusfield will also be limited to the amount of fees payable under these terms and conditions and you won’t be liable to Crocusfield or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if Crocusfield has advised you of them. 
These terms and conditions will be governed and construed in accordance with Dutch Civil Law.
